<p>As with any state, if you intend carrying out a background check Texas has its own state laws on what is required. Most of these, however, refer to when checks must be carried out, such as the requirement of the University of Texas Health Science Center that all new students should be subject to a criminal background screening before being admitted.</p>
<p>Texas is also very strong on screening of day care employees, and rightly so. The costs of bad or negligent hiring can be very high for a local authority as it can be for a private company. In fact a serious negligent hiring lawsuit can destroy a small company, which is why background screening is so important these days. By carrying out the task properly you can reduce hiring problems within your company, and reduce risks to your staff and your company.</p>
<p>In Texas, as in most other states, the candidates themselves have certain rights. You must notify any potential employee of the fact that they will be subject to such employment screening checks, and must also respect the rights to privacy of the potential employees. Additional to that, if you intend having the background checks carried out by a third party, then in Texas, as anywhere else in the USA, you are obliged to receive signed permission from the person involved before you can do so. This is not necessary if you carry out the checks yourself, either personally or through another employee within your company.</p>
<p>Employment background checks are essential since many applicants falsify the information provided in their application forms, and what you decide to verify will depend to an extent on the type of work to be done. Your main obligation is to make sure that the prospective employee is qualified to work in the USA, but you have to make sure that he or she does not have a propensity to inflict violence on others. You will have other checks to carry out depending on the job on offer.</p>
<p>The criminal background check is necessary as protection for your existing employees, and if you fail to do this and an employee is assaulted, then you will be found negligent. You are responsible even if your employee is working out of the plant. Just a short while ago the Texas Supreme Court found cleaner company Kirby negligent for failing to carry out an adequate screening of an independent contractor who raped a woman in her home while demonstrating a vacuum cleaner. It cost them $160,000. Could your business afford this?</p>
<p>If you are employing an accountant you will likely want to carry out an additional credit check, and other common background checks Texas employers carry out are employment history, to find if there are any gaps that have not been volunteered in the résumé, and history of residence. Some people claim to have been living out of state to cover up periods in penal institutions. You could also check out court records, though this is not easy to do out of state without actually traveling to the court. Without that, it can sometimes be difficult to thoroughly check out someone’s criminal records since there is no national criminal database that can be accessed by embers of the public.</p>
<p>Even Texas state records are only as good as those counties that send details in. Frequently it is only by checking out court records that you can find out if anybody has actually been in prison or not. Some courts have electronic systems available for carrying out such searches, but with others you have to thumb through the paper records to find what you are looking for. Some courts will post the results to you while others insist on you picking them up personally.</p>
<p>In such cases it is generally more convenient to employ professionals to do the job. The professionals know all the legal obligations that have to be observed, both from your point of view and from that of the subject. Small businesses, however, often cannot afford to hire a professional investigator to carry out the screening and will have to do it themselves.</p>
<p>You are not expected to investigate every possible aspect of a job applicant’s life history, but you are expected to carry out the basic background checks that would throw up facts about their criminal history, or whether or not they have lied about their past work experience or even residential history. If you are employing someone in a day care or child care center then you have a legal obligation to do so. Texas law demands it.</p>
<p>If an incident occurs, and you are unable to demonstrate that you had carried out reasonable pre-employment screening or the proper background checks Texas employers are expected to carry out, then you are likely to be found liable for the results of negligent hiring. The penalties are commensurate with the crime carried out by the employee, but can include fines of many hundreds of thousands of dollars.</p>

<p>Network Marketing on-line has taken a drastic turn with new technology thwarting us at every turn. Our e-mails are eaten by SPAM guard, our cookies crumbled by anti-spy, and our banners and sites blocked by ad blockers, graphic blockers, and firewalls.</p>
<p>Imagine for a minute though that you own no computer, there is no internet, and you are lucky to have a phone. TV is thought of as a fad that will pass in time and the radio is the only mass media in sight. The date is not important but the era was the 1950’s and my dad sold Kirby Vacuums door to door. I know, you are thinking, “What has that got to do with me?”, but wait.</p>
<p>Dad’s journey would take him from town to town and door to door and most doors resulted in sore toes and one more reminder that this might not be the job for him. Ever feel like that about your online business? You are not alone. My dad soon decided the door to door thing was just plain senseless, and when he knew he was going to be in a town the next week he would drive over that weekend and pay a boy a couple bucks to post flyers around town and call Kirby to arrange an appointment to see this amazing vacuum.</p>
<p>Yes, back to 2007, and our banners are blocked, our sites and ads not viewed. Ok back in time once more as we look at the concept here. My Dad automated a part of his business by posting flyers and setting meetings. He was gathering hot leads targeted to his product and saved tons of sore toes. Since he was in one town for 3-5 days he could not go to 500 homes and make money off the 5-10 that let him in, instead he spoke only with people who wanted a vacuum cleaner.</p>
<p>See, this is why we spend so much time gathering leads and building an e-mail list, and why those list have been so effective, but now at every turn we find those very ads blocked. If we are very successful the e-mail host block our IP, and opt-in or not they sometimes even report us for SPAM. The field when you have the tools to do it right is still dangerous because of false claims, and common assumptions, like safe list for example. A safe list member can get over 5,000 e-mails a day from one list, and even though you and the member know it’s not SPAM the e-mail host says hey, no-one in their right mind wants 5,000 e-mails this site must be SPAMMING them to death and blocks the IP. The safe list owner is never told of this so do blame them if you find your favorite is being blocked on MSN and Yahoo and hang it up on AOL.</p>
<p>So the point in our topic was getting back to the basics of network marketing to save it’s future. The latest craze is social networking and it relates back to dad’s Kirby. See, the right targeted community, just like this forum is full of people looking for that proverbial vacuum cleaner, they are a targeted crowd looking for a specific item. Some are here for knowledge and if you feed them information they follow like flies. Some are here for advertising and may miss the point entirely, but all are here to make money in one way or another.</p>
<p>They say you catch more flies with honey and that also holds true. No matter how good the ad or how much training on paper you do more people will follow a friend that supports them than anyone. See it’s somewhat like the concept of something free in every issue, you keep feeding their mind and they keep coming back for more. The more personal the level of support and the more people will take the bait and follow your lead. On forums, in chat-rooms, and even on My Space the person who follows up and follows through will have more friends and a greater level of success.</p>
<p>So what do you need to do to get to point B? Take each word of this forum, each piece of text on every site, and all that stuff from the e-books you read and digest every drop until it pours from your head like water. Be the guy in the know and share what you know at every venue and you can develop a following that would stand beside you in any marketing battle. The time you spend with each new down-line member counts towards this too. Show them support, teach them a system, make them a friend, and earn them some money and you will see that same name in program after program helping you grow rich.</p>
<p>Network marketing has changed a lot over the years, and while a lot of it is for the good, some has hurt us. Since the invention of the internet we have the ability to reach millions at the touch of a button, but in our haste to reach millions we often forget the few that make our teams core. Soon they will forget about us and move on to do the same with others.</p>
<p>Network marketing is not about the numbers, it’s about the people. You can have 100 people in your 1st level and make less than the guy with 10 good people who get 10 good people and works the system to its fullest. The support and training system always starts with you, step forward and be a leader and your team will follow and do as you do. Set and forget like an ad on a classified site and you will lose.</p>

<p>I can&#8217;t believe it. I&#8217;ve talked to many, many people who are afraid to make a decision to go into network marketing. They&#8217;ve heard stories and rumors. Instead of investigating and coming to their own conclusions, they believe all of what they hear.</p>
<p>They rather work two or three jobs and never see their kids or their spouse than to do a little digging, a little research and find out the truth about network marketing-the thing that could change their financial destiny and allow them to live their dreams. Here are the top myths that stifle people&#8217;s dreams.</p>
<p>1.They&#8217;re all pyramid schemes.</p>
<p>A pyramid scheme is just a money game. There&#8217;s no real product or service. You make money basically by signing up people-which is illegal. A legitimate company supplies a real viable product or service to the marketplace.</p>
<p>2.Only those that get in early make money.</p>
<p>I don&#8217;t see how this makes any logical sense. If a company is legitimate, then it shouldn&#8217;t matter when you get in, because you can still make money. However, if a company only exists to scam as many people as possible before going out of business, then I could see this myth making sense in that regard.</p>
<p>3.You must go door to door peddling products.</p>
<p>Back in the early Amway days, before computers and the technology we have today, the only way to sell products was door to door. Remember Avon, Kirby vacuum cleaners and the Fuller Brush man? In the technology age, door to door selling becomes a thing of the past, unless you want to work harder and not smarter.</p>
<p>4.You have to recruit your friends.</p>

<p>There is a book called “The Ultimate Guide to Network Marketing: 37 Top Network Marketing Income-Earners Share Their Most Preciously-Guarded Secrets to Building Extreme Wealth” and Chapter 3 has Jim Rohn discussing “Nine Things More Important than Capital for Achieving Network Marketing Success. There are many other great chapters in this book, but I personally love this chapter the best.</p>
<p>The nine things discussed are, Time, Desperation, Determination, Courage, Ambition, Faith, Ingenuity, Heart and Soul, and lastly Personality. I wonder why Jim decided to name 9 things instead of ten, but we will go with what we got.</p>
<p>Lets first discuss Time. Time can be spent in three different ways. You can spend it, waste it, or invest it. Jim says time is more valuable than capital. The time you set aside should not to be wasted, nor given away. How valuable is time? Time wasted can be devastation, but time properly invested is worth a fortune and can perform miracles, so you invest your time.</p>
<p>Desperation. Some might say being desperate is not good. I tend to disagree. Sometimes we get put into situations to test us, and to humble us. But if you stay in that desperate state that’s where the problem can lie. I can recall a time back in college when I desperately needed to pay my rent, and I didn’t have the money. I tried friends and family and no one was able to help me, so I got a job selling Kirby Vacuum cleaners door to door. I absolutely hated that job, but I was desperate. I did what I had to do at the time, instead of sitting on my b.u.t.t. feeling sorry for myself. Now I have ensured that my child will never have to sell anything door to door when she gets to college. Desperation has power and can motivate even the laziest persons of them all.</p>
<p>Determination. There is a fine line between determination and desperation. The difference is seen when I knew I needed a job in college to pay my rent, my attitude was I <strong>must</strong> find a job, but the determination part was when I would keep looking and applying for jobs <strong>until</strong> I found one. Never stopping, never ceasing, having a strong will to accomplish your goal.</p>
<p>Courage. Jim says “Courage…in spite of, not because of, but in spite of…” When I was working that job knowing full good and well that I could do better, hearing folks laugh at me, putting up with a lot of bull. Courage, do do what you have to do and not hold your head in shame about it.</p>
<p>Ambition. “Wow! If I can sell 3, I can sell 33. If I can sell 33, I can sell 103.” Jim describes. Now one can see their dreams of the future.</p>
<p>Faith is very important. How can you convince or share a product or service with anyone if you personally do not have faith in, or believe in it? You can’t. You can say all the right things, but the law of energy will show up, and people will feel that negative energy inside you and will run. What if you had a million dollars and no faith? You’d be poor. You wouldn’t be rich.</p>
<p>Ingenuity. Jim describes: “Putting your brains to work. Probably up until now, you’ve put about 1/10 of your brainpower to work. What if you employed the other 9/10? You can’t believe what can happen. Humans can come up with the most intriguing things to do. Ingenuity. What’s ingenuity worth? A fortune. It is more valuable than money. All you need is a $1 and plenty of ingenuity. Figuring out a way to make it work, make it work, make it work.”</p>
<p>Heart and Soul. I’m sure we have all heard before that people do not join businesses. When you are out recruiting, you are not recruiting people per say to join your business. No, people join YOU! People join people, not business. And if your heart and soul is not right, people are not going to trust you, and ultimately not want to join your business. Jim says “What is a substitute for heart and soul? It’s not money. Money can’t buy heart and soul. Heart and soul is more valuable than a million dollars. A million dollars without heart and soul, you have no life. You are ineffective. But, heart and soul is like the unseen magic that moves people, moves people to buy, moves people to make decisions, moves people to act, moves people to respond.”</p>
<p>Personality. Jim said it best when he said “You’ve just got to spruce up and sharpen up your own personality. You’ve got plenty of personality. Just get it developed to where it is effective every day, and effective no matter who you talk to &#8211; whether it is a child or whether it is a business person. A unique personality that is at home anywhere. Move with ease whether it is with the rich or whether it is with the poor. And it makes no difference to you who is rich or who is poor. A chance to have a unique relationship with whomever. The kind of personality that’s comfortable. The kind of personality that’s not bent out of shape.</p>

<p>As a Clinical Hypnotherapist, I have helped many salesmen go from average to excellent. Sales is all about the subconscious mind. When I was in high school, I sold Kirby vacuum cleaners door to door, and I noticed something very interesting: everyone had the same basic sales presentation, and yet some of us (like me!) were making excellent money, and others were making next to nothing. What is the difference?</p>
<p>The Devil is in the Details</p>
<p>The details of our sales presentations were the only things that differed—and sometimes those details are minute—even undetectable. They might occur on the subconscious level or the salesman, or they might be things that the salesman consciously does in order to influence the subconscious mind of their prospective client. The point is that, if you have a proven sales presentation, the difference between being excellent and being a failure is all up to you, and the details of your delivery of the presentation. Before I give you these three ways to improve your sales presentation, I want to talk, just briefly, about the details that the salesman isn&#8217;t even aware of. These details are a result of the salesman&#8217;s subconscious belief that he can sell; that he can be persuasive. I&#8217;ve helped many salesmen improve their selling skills just with a little bit of hypnosis and self-hypnosis coaching. If you are serious about improving your selling abilities, get help through hypnosis for the really small details, and incorporate these three simple techniques into your presentation. You&#8217;ll be able to take the results to the bank.</p>
<p>1. Group your benefits into sets of three. The human mind likes sets of three; it is kind of uncanny. I&#8217;m not sure why, but the human mind will pay more attention to three things than it will to two or four. In my vacuum selling presentation, I might choose to discuss the cleaning power, convenience and durability of the vacuum, making sure to include those words in the same sentence. That way, I&#8217;ll hit my potential customer with three benefits at once, and their subconscious mind will take note and be interested. That&#8217;s why I&#8217;m giving you three suggestions here and not two or four.</p>
<p>2. Excite the imagination of your prospects by invoking all of the senses and using vivid descriptions. The decision to purchase something is influenced profoundly by the subconscious mind, and the imagination is intimately related to the subconscious. You might say something to the effect of, &#8220;As you hear the vacuum start up you can feel its tremendous cleaning power as you see the dirt being sucked from the carpet and smell the fresh scent of the clean room.&#8221; In that sentence, I invoked four senses. My prospective customer is very likely to be in tune with one of those, and the others will just help to increase the power of my words to influence his or her imagination.</p>
<p>3. Nod your head—at the appropriate time. Many salesmen know about this &#8220;trick&#8221;, but misunderstand it and use it the wrong way. When someone nods their head, it has a subconscious effect on the other person in the conversation. Most salesmen don&#8217;t understand what this effect is, and they misuse it. When another person nods their head, they are giving their approval—offering their agreement. The subconscious mind thinks that agreement and approval is being offered because of what its feeling. If you have a customer who is irritated, and you nod your head as you&#8217;re talking to them, they&#8217;re just going to become more irritated. On the other hand, if you have a customer who is happy and excited, and you nod your head, they are likely to become happier and more excited. When you ask for the sale, be sure your customer is in the right frame of mind, and reinforce that good frame of mind with a nod. You&#8217;ll be pleased with the results.</p>
<p>If you incorporate these three tips into your sales presentations, you&#8217;ll be able to take the results to the bank. I&#8217;m certain that you&#8217;ll enjoy that. If you make becoming a better salesman an obsession, you will take even more to the bank. The next step to becoming a better salesman is to work on your own subconscious, by seeing a hypnotherapist and/or using self-hypnosis. You&#8217;ll be able to affect the subconscious changes in yourself that are necessary to make you an elite salesman—and you can be very, very elite. Congratulations in advance on the excellent progress I know you will make when you use these techniques and work on your own subconscious mind.</p>
